1. Acceptance of Terms

By accessing or using LocalTaxCut.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

LocalTaxCut.com is an information and technology service. We provide:

  • Property tax assessment data and comparable sales information
  • Market analysis and valuation reports
  • Educational materials about property tax appeal processes
  • County-specific filing information and deadlines
  • Data visualization and analysis tools

We are your research team, not your lawyer.

3. What We Are NOT

LocalTaxCut.com is NOT:

  • A Law Firm: We do not provide legal advice or legal representation.
  • A Tax Advisory Service: We do not provide tax advice or tax planning services.
  • A Property Tax Representative: We do not represent you before county assessors or appeal boards.
  • A Filing Service: We do not complete forms, file appeals, or submit documents on your behalf.
  • An Agent: We do not communicate with government offices as your agent or representative.
  • A Hearing Representative: We do not appear at hearings or present your case to assessors.

If you need legal representation or professional tax advice, consult a licensed attorney or certified public accountant in your jurisdiction.

4. Your Responsibilities

You are solely responsible for:

  1. Verifying Data Accuracy: Reviewing all data and information we provide for accuracy and completeness.
  2. Making Decisions: Determining whether to file a property tax appeal based on the evidence.
  3. Preparing Documents: Completing all required forms and documentation for your appeal.
  4. Filing Your Appeal: Submitting all forms and evidence to the appropriate government office.
  5. Meeting Deadlines: Ensuring all filings are submitted before applicable deadlines.
  6. Attending Hearings: Appearing at any required hearings or meetings.
  7. Following Local Rules: Complying with all local procedures, rules, and requirements.
  8. Managing Communications: Handling all communications with county assessors and appeal boards.

You are your own best advocate; we just hand you the playbook.

5. No Guarantee of Results

We make NO guarantees regarding the outcome of your property tax appeal.

Success depends on many factors beyond our control, including:

  • County assessor policies and decisions
  • Appeal board composition and rulings
  • Market conditions and comparable sales availability

6. Data Sources and Accuracy

Our data is compiled from publicly available sources and third-party data providers, including:

While we strive for accuracy, we cannot guarantee the completeness or accuracy of all information.

You should independently verify any data before relying on it for your appeal. Errors in public records, data entry mistakes, and outdated information may occur.

7. Pricing and Payments

Free Services:

  • Initial property lookup and basic assessment information
  • Preliminary overcharge analysis
  • County filing deadline information

Paid Services ($85 "Auditor's Report"):

  • Comprehensive comparable sales analysis
  • Detailed market value report
  • Neighborhood variance analysis
  • County-specific appeal strategy
  • Evidence package for your appeal

All payments are processed securely through Stripe. Prices are subject to change.

Refund Policy: Due to the immediate delivery of digital information products, all sales are final. No refunds are provided after you receive your report.

8. User Accounts and Privacy

To use certain features of the Service, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We collect and use personal information as described in our Privacy Policy. By using the Service, you consent to our data practices.

We will never sell your personal information to third parties.

9. Intellectual Property

All content on LocalTaxCut.com, including reports, analysis, software, design, and text, is owned by LocalTaxCut.com or its licensors and is protected by copyright and other intellectual property laws.

License Grant: When you purchase a report, we grant you a limited, non-exclusive, non-transferable license to use the report for your personal property tax appeal only.

Restrictions: You may NOT:

  • Resell, redistribute, or share reports with others
  • Use reports for commercial purposes
  • Reverse engineer or copy our software or analysis methods
  • Remove copyright or proprietary notices from reports

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

LocalTaxCut.com and its owners, employees, and affiliates shall NOT be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, lost savings, or lost tax refunds
  • Damages resulting from errors or omissions in data
  • Damages from unsuccessful appeals or denied claims
  • Damages from missed deadlines or procedural errors
  • Damages from reliance on information provided

Our total liability to you for any claim shall not exceed the amount you paid for the Service (maximum $85).

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, completeness, or reliability of data
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties that defects will be corrected

We do not warrant that the information provided will result in a successful appeal or tax reduction.

12. Indemnification

You agree to indemnify, defend, and hold harmless LocalTaxCut.com and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your property tax appeal or related activities
  • Your violation of any third-party rights

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

Dispute Resolution: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service
  • Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. Previously purchased reports remain accessible for a reasonable period.

15. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and LocalTaxCut.com regarding the Service.

Severability: If any provision of these Terms is found invalid, the remaining provisions will remain in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign these Terms without our written consent. We may assign these Terms at any time.

No Agency: These Terms do not create any agency, partnership, or joint venture relationship.
